After arguments, this writ petition is disposed of as not pressed but liberty, as prayed for, is granted to the petitioner-school to initiate proceedings against the respondent no.1 in terms of Rule 120 of the Delhi School Education Rules, 1973 and the other applicable rules, guidelines, circulars etc for taking action for removal of the respondent no.1 from services inasmuch as the case of the petitioner is that respondent no.1 was illegally appointed to the post in question.

Without in any manner opining as to the defences which the respondent no.1 will take and this order being no reflection on merits of the matter of either of the parties, this writ petition is allowed to be withdrawn with the aforesaid liberty.
