O R D E R

% 06.09.2016 Petitioner seeks parole on the ground of filing the Special Leave Petition in the Supreme Court after engaging a private counsel of his choice. Petitioner has suffered incarceration for more than four years. Petitioner was acquitted by the trial court. State preferred an appeal, which has been allowed and petitioner has been convicted under Section 302 IPC and Sections 25/27 of the Arms Act, 1959 vide judgment dated 17th December, 2014.

Petitioner intends to prefer Special Leave Petition against this judgment.

It is trite to say that every convict is entitled to avail all the legal remedies as may be available to him/her upto the highest forum by engaging

a counsel of his/her choice. Address of the petitioner has been verified by the State.

Accordingly, it is ordered that petitioner be released on parole for a period of one month from the date of his release, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount to the satisfaction of the jail superintendent. During the parole, petitioner shall stay at the address given in the petition and verified by the State. Petitioner shall also appear before the SHO, Police Station Karawal Nagar once a week at 10:00 am, that is, on Mondays.

On completion of parole period, petitioner shall surrender before the Superintendent Jail.

Writ petition is disposed of in the above terms. Copy of the order be sent to the Jail Superintendent for serving it upon the petitioner and for compliance.
