% 08.11.2016 By the present petition filed under Article 227 of the Constitution of India, the petitioner seeks to impugn the order dated 31.03.2016 whereby the trial court dismissed the application filed by the plaintiff/petitioner seeking recall of the order dated 16.02.2016 whereby the evidence of the plaintiff was closed and fixed the matter for final arguments on 28.04.2016. On the last two dates, when the matter came up for hearing before court, namely, 01.08.2016 and 27.10.2016, the matter was adjourned at the request of the petitioner.

Today, none is present for the petitioner. It appears that the petitioner is not interested in pursuing the present case. Accordingly, the petition is dismissed in default. All pending applications also stand dismissed.
