Mr. Dhaman Trivedi, ld. counsel for the Appellant appearing on behalf of Mr. Ankur Sood, ld. counsel from DHCLSC, submits that the Appellant has engaged his own counsel namely, Mr. Vivek Sood. Accordingly, Mr. Ankur Sood, ld. counsel stands discharged.

As per the Nominal Roll, the Appellant was released on 22nd August, 2013 after completion of his sentence.

At this stage, Appellant has appeared in person. 7.
The present appeal has been filed by the Appellant- Amit Kumar Jha under Section 374(2) of the Code of Criminal Procedure Code, 1973 against the judgment and order on sentence dated 23rd August, 2010 and 31st August, 2010 passed by Learned Additional Session Judge-03 (West) in Session Case No.70/2008, FIR No.502/07, under Sections 363/366/376 of Indian Penal Code (IPC) registered at Police Station Timar Pur, Delhi. 8.
The Appellant was convicted under Section 366/376 of IPC and sentenced to RI for 05 years and fine of Rupees 1,000/- in default SI for period of 2 months and sentenced to RI for 07 years and fine of Rupees 1,000/- in default SI for period of 2 months. Both the sentences shall run concurrently.

The Appellant states that he does not wish to press the present appeal on the ground that it has become infructuous as he has already served his sentence.

The Appellant has been identified by Investigating Officer/SI Jagroshni, PS Timar Pur. After questioning from the Appellant, this Court is satisfied that he is making the statement after knowing the consequences of the same as he has been made aware of the consequences of his statement. 11.

Keeping in view the statement of the Appellant, which is taken on record, and the fact that the Appellant has already served the sentence awarded by the Trial Court, the present appeal is disposed of as not pressed. 13.
