This is an application under Order XXIII Rules 1 and 3 CPC, though only titled under Order XXIII Rule 1 CPC, inasmuch as, parties have settled their disputes which are subject matter of the suit in terms of the Settlement Agreement dated 24.02.2016 and copy of which has been filed with the application.

The suit will stand disposed of in terms of the settlement and plaintiff CS(OS) No.3116/2011

has today handed over to the defendant a Demand Draft for a sum of Rs.21 lakhs drawn on Indusind Bank dated 04.02.2016 numbered 723422, and which Demand Draft the defendant has received in full and final satisfaction of the disputes which arose between the parties and are subject matter of the present suit.
