% 22.07.2016 The present petition has been filed under Section 482 Cr.P.C. read with Section 439(2) of Cr.P.C for setting aside and quashing the impugned order dated 20.07.2016 passed by the learned ASJ whereby the respondent No.2 was admitted to anticipatory bail till 22.08.2016 in FIR No.1116/2015under Sections 420/467/468/471/506/120B IPC Police Station K.N.K.Marg.

The contention raised by the learned senior counsel for the petitioner is that the order dated 22.08.2016 is not sustainable in the

eyes of law as the anticipatory bail application of the co-accused who has a lesser role in the matter has been dismissed. After some arguments, the learned counsel for the petitioner has sought permission to withdraw the present petition with liberty to raise all the grounds mentioned in the present petition before the court below which has granted anticipatory bail to the respondent No.2. Consequently, the present petition is dismissed as withdrawn with liberty to the petitioner to move the court below. Dasti.
