O R D E R

% 06.12.2016 Pursuant to the order dated 24th September, 2014, petitioner had deposited Rs.3,12,500/- with the Registrar General of this Court. As per the noting dated 7th January, 2015 this amount has been kept in FDR with UCO Bank.

Petitioner, who is present in person, submits that he is willing to settle the matter with the complainant (respondent no.2). He has offered the amount, lying deposited in this Court along with interest accrued thereon, towards full and final settlement of all the claims of respondent no.2. Learned counsel for the respondent no.2, on the instructions of respondent no.2, submits that respondent no.2 is willing to accept the offer of petitioner and compounding of the offence. Accordingly, offence under Section 138 of the Negotiable Instruments

Act, 1881 is permitted to be compounded. Petitioner is acquitted. His bail bond and surety bond are discharged. Necessary endorsement on the FDR of `20,000/-,furnished by the surety, may be made by the Registry. The amount lying deposited in this Court together with interest accrued thereon, if any, be released to the respondent no.2 forthwith. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
