W.P.(CRL) 2130/2016 On the complaint of respondent no.2, FIR No.247/2014 under Section 363 IPC was registered at Police Station Neb Sarai against petitioner no.1. Petitioner no.2 is the daughter of respondent no.2. Respondent no.2 has alleged in the FIR that petitioner no.2 was missing from 26th March, 2014. The age of petitioner no.2 given in the FIR was 16 years. Now, she is major.
Petitioner no.2 has married the petitioner no.1 and is living with
him. Petitioner no.2 as well as respondent no.2 are present in Court. Respondent no.2 has accepted the marriage.
She has no objection, in case the FIR is quashed.
Keeping in mind the fact that the matter is still at the investigation stage, in the interest of justice, the FIR No.247/2014 under Section 363 IPC registered at Police Station Neb Sarai and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
