% 11.05.2016 The present petition has been filed seeking quashing of FIR No.98/2012 under Sections 448/380/385/34 IPC, registered at Police Station: Kingsway Camp, Model Town, Delhi.
The petition came up for hearing for the first time on 25.11.2013 when notice was directed to be issued to respondent No.2 returnable for 06.12.2013. On 06.12.2013, the learned counsel for respondent No.2 entered appearance and sought time to file the power of attorney. It was also stated that the connected petition is coming up on 20.01.2014 and the matter was adjourned to be listed along with the connected petition on 20.01.2014. On 20.01.2014, it was stated
that the investigation in the connected petition was still going on and thus the matter was adjourned to 22.07.2014. Thereafter the matter was adjourned on a couple of dates till 13.02.2015 when again none appeared for the petitioner and the matter was adjourned to 06.05.2015. On 06.05.2015, an adjournment was sought on behalf of the petitioner on the ground that the main counsel was not available and thus the matter was adjourned to 14.10.2015. On the next two dates of hearing i.e.14.10.2015 & 09.02.2016, again none appeared for the petitioner.
Today also, there is no appearance on behalf of the petitioner despite the matter being called thrice.
In the given facts and circumstances, it appears that the petitioner is no more interested in prosecuting the matter. Dismissed for non prosecution.
