% 12.05.2017 The petitioners are present in person. The second and third respondents are also present in person. The second petitioner is daughter of the second respondent and sister of the third respondent. Both the said parties have had some communication outside the court with each other prior to the case being taken up. The second and third respondent fairly concede that the second petitioner is a major. She in turn states that she has entered into marriage out of her free will and volition with the first petitioner.

Inspector Manoj Kumar Mishra (fourth respondent) is present with the police file. He states that the petitioners are not coming forward to arrange the statement of the second petitioner to be recorded.

The counsel appearing for the petitioners undertakes that the petitioners would cooperate with the investigating police officer to have her statement recorded under Section 161 Cr. PC and if it be deemed necessary by the investigating police officer, also under Section 164 Cr. PC before the Magistrate. He, however, submits that appropriate steps be taken for protecting the life, liberty and wellbeing of the petitioners. ASI Ram Kumar is present for and on behalf of SHO Police Station, Nangloi in the area of which the petitioners are presently living.

The local police shall make available the contact telephone numbers of the SHO, divisional officer and the beat staff to the petitioners who in turn shall also give their respective contact telephone numbers to the local police of the area of their residence, to be properly sensitized, so that in case of need appropriate assistance to protect the life and well-being of the petitioners can be arranged. The second and third respondents on being asked submit that they do not wish or intend to bring any harm to the petitioners acknowledging that both are major and have taken the decision to marry with each other out of their free will and volition. The petitioners do not press for any further direction. The petition is disposed of accordingly.
