JUDGMENT

% (ORAL) In this petition, cancellation of pre-arrest bail granted to respondent-accused is sought on the ground that respondent no. 2 is not complying with the undertaking of paying maintenance of `6500/- per month.

Learned counsel for respondent-accused submits that respondent-accused wanted to pay the maintenance amount, in cash, but the petitioner was not ready to accept the same. It is pointed out by learned counsel for petitioner that the arrears of CRL.M.C. 4374/2014

maintenance are `65,000/-. Learned counsel for respondentaccused submits that today, an amount of Rs. `19,500/- has been brought by respondent-accused, in cash, but petitioner is not ready to accept the same and submits that she wants the entire arrears in one go.

In the facts and circumstances of this case, no case for cancellation of pre-arrest bail granted to respondent-accused is made out. Let respondent-accused deposit the arrears of maintenance with the trial court and continue to pay the maintenance amount in terms of order of 12th August, 2014.
