% 08.02.2017 It is submitted by the learned counsel for the petitioner that general allegations have been levelled by the complainant against the petitioner in the FIR, that too, after seven years of their marriage. It is submitted that complainant could not adjust in the family and hence, the petitioner shifted along with her in a rented accommodation, however, the behaviour of the complainant did not change. Petitioner was compelled to leave the house. Petitioner has cooperated during the investigation. He may be granted anticipatory bail. Learned APP has opposed the grant of anticipatory bail to the petitioner and submits that dowry articles have yet not been returned by the petitioner. The complainant was not treated properly after the marriage. Petitioner did not take the complainant for outings i.e. for shopping etc. and instead he would beat her off and on. On
27.03.2012, complainant was turned out of the house. Thereafter, the complainant and the petitioner started living in a rented accommodation.
On 02.11.2013 mami of the complainant had expired but the petitioner did not take her there; instead he beat her up. On 25.03.2014 petitioner left the matrimonial home without any reason.
Allegations and counter allegations have to be verified during the investigation and in the trial as the case may be. Keeping in mind the totality the facts and circumstances of the present matter, it is ordered that in case of arrest petitioner be released on bail subject to his furnishing a personal bond in the sum of `25,000/- with one surety in the like amount to the satisfaction of Arresting Officer/Investigating Officer/SHO of the concerned police station.
Bail application is disposed of in the above terms.
Miscellaneous applications are disposed of as infructuous. Dasti.
