Petitioner seeks anticipatory bail in FIR No.919/2015 under Sections 406/34 IPC at Police Station Patel Nagar. 2.

Allegations in the FIR are that the complainant had entered into an agreement to purchase a flat with one M/s Mahadev Housing Projects Pvt. Ltd. and had paid Rs.40 lacs. Subsequently, the complainant got to know that the property is owned by the petitioner and petitioner was disputing that he had authorised the said company to sell the flat.

Learned senior counsel for the petitioner submits that the said M/s Mahadev Housing Projects. Pvt. Ltd. has forged and fabricated certain documents for which a complaint has been filed and FIR registered. He further submits that the document based on which the BAIL APPLN. 1707/2018

alleged transaction is stated to have been entered is itself a forged document. He further submits that in the subject FIR the co-accused has already been granted anticipatory bail by order dated 22.05.2018 by the Trial Court.

By order dated 23.07.2018, the petitioner was granted interim protection subject to joining investigation.

Learned Addl. PP submits that the investigation is complete, however, no incriminating evidence has been found against the petitioner and accordingly he has been placed in Column No. 12 and chargesheet has already been filed in Court.

Since the petitioner has been placed in Col. 12 and there is no apprehension of arrest, at this stage, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to approach afresh in case the need so arises.

The petition is accordingly dismissed as withdrawn with liberty as prayed for.
