The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.734/2015 under Section 420/120B IPC registered at Police Station Prashant Vihar. Status report not filed. 2.

I have heard the learned counsel for the parties including the complainant's counsel and have examined the file. The petitioner is in custody since 11.4.2016. Earlier the petitioner was granted bail. Since he absconded during trial, non-bailable warrants were issued against him and he was taken into custody on 11.4.2016. Presently possession of the premises in question is admittedly with the complainant.

Considering the facts and circumstances of the case and the role assigned to the petitioner, he is admitted to bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the Trial Court. 4.

The applications stand disposed of.
