CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 27.07.2016 Disputes between husband and wife had led to the registration of present FIR No.101/2014 under Sections 498A/406/34 IPC at police station Ambedkar Nagar.

Parties have settled their disputes before the Principal Judge, Family Courts (South), Saket, New Delhi. In terms of the settlement, petitioner no.1 and respondent no.2 have taken a divorce by mutual consent from the Family Court, Saket, New Delhi on 8th February, 2016.

Respondent no.2 is present in Court and admits that she has received the entire settled amount from petitioner no.1. She submits that she has no objection, if the present FIR is quashed.

Keeping in mind the facts that during the investigation, petitioner no.1 and respondent no.2 have decided to part their ways and have taken a decree of divorce by mutual consent, no fruitful purpose would be served by keeping the criminal proceedings pending, in the interest of justice, the FIR No.101/2014 under Sections 498A/406/34 IPC registered at police station Ambedkar Nagar and the consequent proceedings emanating therefrom are quashed.

Writ petition is disposed of in the above terms. Dasti.

A.K. PATHAK, J.
