O R D E R

% 24.07.2018 The reply filed by the SHO police station Prashant Vihar is taken on record through the Additional Public Prosecutor. During the course of hearing, the learned Additional Public Prosecutor submitted, on instructions, that till date the investigating agency has not even issued or served a notice under Section 160 Cr.P.C. on the petitioner. He submitted that the investigation is still at the initial stages where concrete material is being gathered apart from the oral statements of the complainant and those cited by her as witnesses. He submitted that in case the petitioner is to be arrested, the investigating officer is ready to give advance notice of four working days. BAIL APPLN. 1720/2018 Bail Appl. 460/2018 & conn.

In this view of the submission, the petition and the application filed therewith are presently disposed of with the direction that the petitioner will not be arrested in context of FIR No. 101/2018, under Sections 409/420/506/34 IPC registered at Police Station Prashant Vihar, without he being served with a prior notice of clear four working days.
