% 23.07.2018 Notice. Learned APP accepts notice for respondent no.1. Respondent nos.2 and 3 are present in Court along with their counsel and accept notice. They have been identified by SI Ranjeet Singh of police station Subzi Mandi.
It is submitted that respondent no. 2 is father of respondent no. 3. Respondent no. 2 lodged an FIR No. 231/2009 under Section 363 IPC at Police Station Subzi Mandi. Respondent no. 2 alleged in the FIR that his daughter (respondent no. 3), aged about 17 years, was missing from the
house. Respondent no. 2 further alleged in the FIR that he suspected that petitioner had taken away his daughter with him after enticing her. Respondent no. 3 is now 28 years of age. Respondent nos. 2 and 3 submit that they have settled the matter with the petitioner of their own free will and without any undue force, pressure or coercion, vide a Compromise/Settlement Deed dated 16th July, 2018. They submit that they have no objection in case aforesaid FIR is quashed against the petitioner. Affidavits of respondent nos. 2 and 3 are on record at pages 13 to 16. Keeping in mind the settlement arrived at between the parties voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
