The petitioner's claim is with respect to the refund of an amount of `3.55 Crores on account of excess payment made under the Delhi Value Added Tax Act, 2004 to which the counsel for the respondents contends that the petitioner's appeal was allowed and the matter was remitted to the Assessing Authority by order dated 28.12.2017 and as on date the proceedings are not yet concluded. It appears that the petitioner was asked to appear before the Adjudicating Authority, who then adjourned the assessment proceedings. Learned counsel for the respondents submits that the Adjudicating Authority (VATO Ward-94) would complete the
proceedings; after giving necessary hearing to the petitioner, in accordance with law, within four weeks. It is so directed. The writ petition is disposed of in the above terms along with the pending application.
A copy of the order be given dasti under the signatures of the Court Master.
