O R D E R

% 01.11.2018 Notice could not be issued to respondent no.2 as process fee was not filed. However, respondent no.2 has appeared in Court and has been identified by SI Kuldeep Singh of police station Chhawla. Respondent no.2 submits that he has settled the matter of his own free will and without any undue force, pressure or coercion vide Memorandum of Understanding dated 06.07.2018. He further submits that in view of the settlement he has no objection in case FIR No. 147/2009 under Sections 420/468/471/120B/34 IPC registered at police station Chhawla and the consequent proceedings are quashed.

Keeping in mind that the disputes are in respect of an immovable property which have been settled by the petitioner and respondent no.2

voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending.

Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.
