% 27.07.2017 This petition is filed under section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator. It is stated that the respondent was awarded a work order on 16.5.2011 for the work of its project to be executed at Wave City, NH-24, Ghaziabad for the work of Sewerage Works (Public Health Services). Disputes have arisen between the parties. The Agreement between the parties has an arbitration clause. Clause 9.03 of the Agreement dated 16.5.2011 has an arbitration clause whereby in case of dispute the matter is to be referred to adjudication of an Arbitrator to be nominated by the respondent.

Learned counsel for the respondent has entered appearance and submits he has no objection in case an Arbitrator is appointed by this court. Parties agree that the arbitration be conducted under the aegis of Delhi International Arbitration Centre who will appoint an arbitrator from their

panel.

Copy of this order be sent to the said DIAC.

Petition stands disposed of. All pending applications, if any, also stand disposed of.
