The present petition has been filed by the petitioners for setting aside the order dated 5th May, 2016 vide which the bail under Section 437 (3) of the Code of Criminal Procedure, has been granted subject to the condition of payment of Rs.9,00,000/-. The contention of the petitioner is that while accepting the bail under Section 437(3) Cr.P.C., the Court should not have imposed the condition of deposit and that the order passed by the Court below with the condition of deposit is not acceptable to them.

In such a scenario, this Court is of the considered opinion that the order passed by the Court below is set aside. It has been submitted that the date is already fixed on 30th September, 2016. The Court below is directed to pass fresh order under Section 436 of Cr. P.C. on its merits after hearing the parties.

The present petition and application are disposed of with the above observation.
