% 01.05.2017 After some hearing, counsel for the petitioners submits he is under instructions to withdraw the petition.

It is dismissed accordingly.

The status report dated 10.11.2016 submitted by SHO police station Sagarpur has brought out that the subject land is also subject matter of another similarly placed case it being presently under investigation, it being FIR No.

308/2002 involving offences under Sections 420/448/468/471/120B/34 IPC of police station Dabri. In the facts and circumstances brought out in the said report, it is desirable that the said FIR of police station Dabri and FIR No. 93/2016 under sections 420/467/468/471/120B/506/34 IPC of police station Sagarpur are investigated into by the same investigating agency. The learned W.P.(CRL) 2236/2016

additional standing counsel submits that both police stations Sagarpur and Dabri fall under the same district, it being South West district. In these circumstances, the Deputy Commissioner of South West is directed to hand over the investigation of both the said crimes to the same investigating agency.

With these observations, the petition is disposed of. A Copy of the order be given dasti under the signature of Court Master.
