Parties have entered into a settlement in writing signed before the Delhi High Court Mediation & Conciliation Centre on 3.8.2018. It is agreed that this appeal and litigation be disposed of in terms of the Settlement Agreement dated 3.8.2018.

Accordingly this appeal will stand disposed of as per the agreed terms stated in the Settlement Agreement dated 3.8.2018, and which agreement satisfies the requirements of Order 23 Rule 3 of Code of Civil Procedure, 1908 (CPC).

Counsel for the respondent has handed over to the counsel for the appellant two cheques of Rs.1.25 lacs each with respect to RFA No.576/2013

first two instalments and the cheque of third instalment payable on or before 10.11.2018 will be given by the counsel for the respondent to the counsel for the appellant within three weeks from today.

Appeal is accordingly disposed of in terms of the aforesaid settlement. Respondent will ensure that cheques will be cleared on being presented by the appellant, and which is a term of the settlement. VALMIKI J. MEHTA, J AUGUST 09, 2018 Ne RFA No.576/2013
