CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 11.05.2015 Petitioner seeks parole on the ground of filing Special Leave Petition in the Supreme Court. It is trite to say that every convict is entitled to avail all the remedies as may be available to him under the law upto the highest forum by engaging a counsel of his choice. Address of the petitioner has been verified.

Request of the petitioner has been rejected by the Govt. of NCT of Delhi on the ground that there is possibility of threat to the victim and witnesses as also that of jumping the parole by the petitioner. However, the grounds on which such an opinion has been formed are not spelled out, inasmuch as, no such apprehension has been propounded in the verification report submitted by the Station House Officer (SHO) of police station Subzi

Mandi.

Keeping in mind totality of the circumstances, it is ordered that petitioner be released on parole for a period of one month from the date of his release, subject to his furnishing a personal bond in the sum of `10,000/- with one surety in the like amount to the satisfaction of Jail Superintendent. During the parole period petitioner shall not leave territorial bounds of Delhi and appear before the SHO of police station Subzi Mandi once in a week, that is, on every Monday at 10:00 am. After completion of parole period petitioner shall surrender before the Superintendent Jail. Writ petition is disposed of in the above terms. Copy of this order be sent to the Jail Superintendent for serving on the petitioner and also for compliance.
