Counsel for the appellant/plaintiff states that for the present the appellant does not intend to pursue the appeal because the respondent/defendant is not using the suit property for commercial purpose for last around three months and which period counsel for the respondent/defendant states is around 6/7 months. 2.

Accordingly this appeal is disposed of as not pressed but in case the respondent uses the suit property for any commercial purpose which is violative of the local laws, then, in such a case the appellant is given liberty to approach the trial court by filing the necessary application. FAO No.343/2016

Appeal is accordingly disposed of with the aforesaid observations.
