O R D E R

% 13.09.2018 By this petition, the petitioner seeks parole on the ground that he has to file Special Leave Petition before the Hon'ble Supreme Court, arrange funds for the same and also challenges the communication dated 13th July, 2018 informing that the application of the petitioner on the ground as above, has been rejected.

Status report has been filed by the State verifying the address of the petitioner to be A-2/361, A-2 Block, Sultanpuri, New Delhi, where his wife along with three children were found residing. The owner of the house is the mother-in-law of the petitioner. Further, as per the nominal roll, the petitioner has been awarded life imprisonment with a direction that his case will not be considered for grant of remission till he has undergone actual 20 years imprisonment.

The sentence of the petitioner was suspended temporarily on number of occasions during the pendency of the appeal before this Court. Though, on one occasion, he surrendered late by one date and did not surrender on the fifth occasion, when he was re-arrested after two months, however, on one occasion, he surrendered before time as well. Considering the facts verified and the nominal roll of the petitioner, this Court deems it fit to grant parole to the petitioner. It is therefore directed that the petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of ₹ 25,000/- with one surety bond of the like amount, to the satisfaction of the learned Trial Court with further condition that the wife of the petitioner will also provide her mobile number which will be kept in active mode, during the period of parole of the petitioner.
