% 11.08.2016 By the present petition the petitioner seek quashing of FIR No.708/2015 under Sections 392/34 IPC registered at PS K.N. Katju Marg on the complaint of respondent No.2.
Notice. Learned APP for the State accepts notice. Learned APP for the State points out that besides two petitioners one more accused is involved who has not been impleaded as party. Be that as it may, the offence alleged is punishable under Section 392 IPC. The same being a serious offence, the above-noted FIR cannot be quashed on the basis of settlement between the parties in view of the decision of the Supreme Court in Gian Singh Vs. State of Punjab & Anr. (2012) 10 SCC 303.
