% 25.07.2018 Learned counsel for the petitioner submits that petitioner has already filed an application before the learned Metropolitan Magistrate regarding maintainability of petition itself in view of the fact that parties had been living in United States of America (USA), inasmuch as, divorce petition as well as maintenance proceedings are pending between them in the USA Court.

Accordingly, Metropolitan Magistrate is directed to dispose of the application of the petitioner first before proceedings further in the matter.

Present

petition is disposed of with the above observations.
