This order is in continuation of the earlier orders dated 2nd September, 2016 and 18th October, 2016.

On 2nd September, 2016, when this suit had come up first, questions were raised from the counsel then appearing for the plaintiffs as to the maintainability thereof and for which the counsel for the plaintiffs had sought time to respond. Thereafter, on 18th October, 2016 an adjournment was sought.

Today, Mr. Sudeesh K.K., Advocate, associate of Mr. Shuvodeep Roy, Advocate who has filed the suit, appears and states that the plaintiffs have already asked Mr. Shuvodeep Roy, Advocate to give a 'No Objection Certificate' (NOC) to the plaintiffs to engage another Advocate and which CS(COMM) 1207/2016

NOC Mr. Shuvodeep Roy, Advocate has already issued. He states that he is appearing only because the name of Mr. Shuvodeep Roy, Advocate continues to be shown in the Cause List of this Court and otherwise has no instructions from the plaintiffs to appear.

None else appears for the plaintiffs.

Dismissed in default.
