J U D G M E N T

MANMOHAN, J: (Oral) 1.

Present petition has been filed for grant of Letters of Administration under Section 278 of the Indian Succession Act, 1925 with respect to the estate of deceased Mr. Gurmukh Singh Dadial.

It is stated that Mr. Gurmukh Singh Dadial, son of Late Shri Amar Singh, resident of 37, Leslie Road, Leytonstone, London E11 4HF died on 18th December, 1999 leaving behind three fixed deposit receipts and a saving bank account as detailed in Schedule I annexed to the present petition.

The death certificate of deceased Mr. Gurmukh Singh Dadial has been exhibited as Ex. PW1/2. The near relatives of the deceased Mr. Gurmukh TEST.CAS. 91/2014

Singh Dadial have filed no objection affidavits and same have been exhibited as Ex. PW1/5 to PW1/8.

Mrs. Surjeet Kaur Dadial, wife of late Mr. Gurmukh Singh Dadial has filed her affidavit by way of evidence. The said affidavit has been exhibited as Ex. PW1/A.

Despite citation, no objection has been filed till date. 6.

Consequently, present petition is allowed and the Letters of Administration in favour of petitioner enabling her to administer the estate of deceased Mr. Gurmukh Singh Dadial is issued, subject to petitioner's filing necessary court fees. Since the Letters of Administration have been filed in the present case only with regard to three fixed deposit receipts and money lying in a saving banks account, the requirement of furnishing of Administrative Bond with two sureties, is dispensed with. 7.

With the aforesaid directions, present petition stands disposed of. List before Joint Registrar on 16th March, 2015 for determination of court fees to be paid.
