% 31.08.2016 This petition has been preferred under Section 439 Cr PC to seek regular bail in case FIR No.244 dated 08.03.2016 registered under Section 420/406/ 468/467/471/34 IPC at PS Bhajanpura, Delhi. The allegation against the petitioner is that he is the recipient of the cheated amount of Rs.28,300/-.
The submission of learned counsel for the petitioner is that he was working with the accused Atther Khan. The cheque in question was collected from the complainant by the co-accused Inam. The case of the accused is that the cheque in question had been given to him as salary by the employer Atther Khan, and he was not aware that the same has been issued
by the complainant in respect of deposit of amount under an insurance policy.
The co-accused has already been granted bail. Counsel for the applicant states that to show his bonafide, without it constituting an admission on his part of any kind whatsoever, the petitioner shall deposit an amount of Rs.30,000/- in the Trial Court within two weeks. In these circumstances, the petition is allowed. The petitioner is directed to be released on bail upon furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Trial Court, and subject to the condition that he deposits the amount of Rs.30,000/- in the Trial Court within two weeks.
The application stands disposed of.
