W.P.(C) 6521/2016 Petitioner is stated to be squatting from a stall at Vikram Vihar, Opp. Vikram Hotel, on footpath leading to LSR College, New Delhi24. Except certain challans, there is no document to substantiate the submission of the petitioner that he is in fact squatting at this stage. Learned counsel for the petitioners submits that he is squatter and he is protected by Section 3(3) of Street Vendor Act, 2014.
Learned counsel for the respondent reiterates his submission that in the absence of the petitioner having renewal of Tehbazari, the officials of the respondents removed his stall. To substantiate his submission he states that he is still squatting at the aforenoted site and he is not having any documentary proof.
Be that as it may, it is not in dispute that the Town Vending Committee qua respondent No.1 has not yet been constituted. As and when the TVC qua respondent No. 1 is constituted, the grievance of the petitioner shall be addressed by the said TVC. This petition is disposed of with the aforesaid direction and liberty is granted to the petitioner to approach the TVC as and when required.
The writ petition is disposed of.
