% 11.12.2018 This petition challenges the order dated 12.04.2018 wherein cost of Rs.40,000/- was imposed upon the defendant while giving the defendant an opportunity to file the written statement. The defendant did not deposit the cost so imposed and filed an application for review of the order dated 12.04.2018 but it was also dismissed on 14.5.2018 with further cost of Rs.10,000/-. The evidence of the defendant/petitioner herein was thus closed.

The learned counsel for the respondent has no objection in case the orders dated 12.04.2018 and 14.05.2018 are set aside and the petitioner is permitted to file his written statement before the Trial Court within 10 days from today provided the learned Trial Court to expedite the trial and complete it within a year from today. Directed accordingly.

The petition and pending application stands disposed of in terms of the above.
