This application is filed by the Official Liquidator under Section 481 of the Companies Act, 1956 with a prayer that the respondent company be dissolved under Section 481 of the Companies Act. It is also prayed that sum of Rs. 64,000/- which is the surplus amount available be permitted to be deposited in this court subject to further orders that may be passed by this court in the dispute between the legal heirs of the petitioner. It has also been stated that the company is left with no immovable property. It has five computers lying in the record room which do not have any value. The amount available is Rs. 64,000/- being the net balance available after taking care of the expenses. Hence, it is prayed that the respondent company be wound up.

The application is allowed.

There is a dispute pending among the legal heirs of the deceased petitioner. The sister of the deceased petitioner has also filed a probate case being Test. Cas. No. 75/2014 which is pending in this court. The dispute is essentially between the sister of the late petitioner and the late petitioner's husband.

Let the Official Liquidator deposit the said balance amount being Rs.64,000/- before the Registrar General of this court who shall keep the same in a fixed deposit. The said amount shall be disbursed on the outcome of the Test Cas.75/2014 or any other civil case between the legal heirs of the petitioner.

Application stands disposed of.
