% 16.09.2016 Learned counsel for Pradeep Rai has submitted that the petitioner is ready and willing to make payment in terms of the award dated 5th May, 2010. He has filed a computation as per which the total amount presently due and payable is Rs.65,847/-.

Learned counsel for the respondent Nos. 1 and 2 submits that it is open to the petitioner to move an application before the Recovery Officer, i.e., Assistant Collector Grade-II. The Assistant Collector Grade-II can verify the computation and examine the question of the amount due and payable under the award dated 5th May, 2010.

In view of the statement made by the counsel for the respondents, the writ petition is disposed of, giving liberty to the petitioner to approach the

Assistant Collector Grade-II by way of an application expressing the petitioner's intention to make the payment of the dues and also enclose with the application the computation made by the petitioner. In case there is any difference between the amount computed and claim of the respondent bank, the said aspect would be examined by the Assistant collector Grade-II with reference to the award dated 5th May, 2010.

In case any application for payment is filed by the petitioner before the Assistant Collector Grade-II, we hope and trust, the application would be taken up expeditiously and would be disposed of preferably within a period of four months from the date the application is filed. We clarify that this Court has not expressed any opinion on merits. 5.

Learned counsel for the petitioner has also stated that he would prefer to settle the matter with the bank. We make no comments on the said aspect, leaving it open to the petitioner to take up the issue of settlement with the bank on his own or before the Recovery Officer. SANJIV KHANNA, J.
