% 26.11.2016 (1) The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.457/2016 under Sections 354/354A/354B/323/341/ 506/34 IPC registered at Police Station New Usmanpur. Status report is on record, in connected matter.
(2) I have heard the learned counsel for the parties and have examined the file. By an order dated 08.08.2016, the petitioner was granted interim protection and was directed to join the investigation as and when required. Learned APP informs that the petitioner has since joined the investigation. Co-accused Neha Jain, Rubi Jain, Reena Jain BAIL APPLN.1537/2016
and Usha Jain have been granted anticipatory bail by Additional Sessions Judge vide order dated 07.06.2016.
The petitioner was directed to join the investigation vide order dated 5.7.2016 by the court below. Pursuant to that, he had joined the investigation on 10th and 11th July, 2016. The victim had lodged case FIR No.308/2015 under Section 376 IPC against the brother-in-law of the petitioner i.e.Rahul Jain. The victim has already been examined in the said case. It is informed that she has not supported the case of the prosecution. (3) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.
(4) The bail application and all pending application(s) stand disposed of.
