% 04.12.2018 CRL.M.A. 48800/2018 (by R-2 for placing documents on record) The case was passed over for the parties to obtain instructions. It is 16.10 hours, the learned counsel for the petitioner is not present in Court. The petitioner seeks appointment of a counsel. In the circumstance, Mr. Manav Gupta, Advocate is appointed as her counsel. The petitioner is also assisted by her uncle in Court.
This application seeks to bring on record certain documents on the basis of which the additional amount of Rs. 2 lacs has been deposited by respondent no. 2. The said monies are payable to the petitioner, in terms of
the MoU entered upon between the parties on 07.10.2016. The said monies are yet to be paid to her. Ties of matrimony between the parties have since been brought to an end by way of a Divorce Decree dated 30.10.2017. In the circumstance, let the said amount of Rs. 2 lacs deposited with the Registrar (General) of this Court be released to the petitioner alongwith the interests accrued thereon by 12.12.2018, upon an application being made by her. In addition to the above, the respondent no. 2 shall pay an amount of Rs. 20,000/- to her within a fortnight from today. The learned counsel for respondent no. 2 states, upon instructions, that the petitioner does not wish to pursue her complaint any further and would rather like to put her unfortunate past behind her and look for happier times in life, provided the monies owed to her, in terms of the MoU alongwith interests thereon, are released to her.
In view of the above, the learned counsel for the petitioner does not press the Transfer Petition being TR.P.(CRL.) 46/2018. It is dismissed as not pressed. It will be open to the parties to take appropriate steps before the Trial Court. The learned counsel for the petitioner states, upon instructions, that the petitioner will cooperate, in right earnest, to give effect to the settlement in letter and spirit.
The petition stands disposed-off in the above terms. A copy of this order be given dasti to the learned counsel for the parties under the signature of the Court Master. NAJMI WAZIRI, J DECEMBER 04, 2018 RW
