% 01.08.2016 Present contempt petition has been filed alleging wilful disobedience of order dated 11th July, 2014 passed in W.P.(C) 6785/2012 whereby a Coordinate Bench of this Court had recorded the statement of respondents that land for approach road to the cremation ground had been identified.

Learned counsel for petitioner states that till date no action has been taken for construction of road/path towards the cremation ground, as a consequence of which the residents of the aforesaid village are facing immense hardship.

Perusal of the order dated 11th July, 2014 reveals that there was no direction by the Court or undertaking by the respondents. The Court only expressed an expectation that the competent authority under respondent no.2 would take all necessary steps expeditiously. Since there was no specific direction or undertaking, this Court is of the opinion that a contempt petition is not maintainable.

Accordingly, the same is dismissed. However, the petitioner is given liberty to file an appropriate proceeding in accordance with law for redressal of its grievance. This Court clarifies that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all the parties are left open. MANMOHAN, J AUGUST 01, 2016 KA
