No one appeared for the appellant when the matter was called. 2.

Learned counsel for the respondent nos.2 &3 are present through VC and he points out that the parties have already settled their disputes in mediation in terms of Settlement Agreement dated 21.08.2019. 3.

It is also submitted that they have already performed their respective obligations and nothing remains to be complied with by any of the parties. It is pointed out that the appellant filed an application under Section 151 of Code of Civil Procedure, 1908 for withdrawal of the instant appeal which was listed vide Diary No.1584201/2019 dated 17.12.2019. 4.

In view of the above, the appeal and the present application are disposed of in terms of the settlement arrived at between the parties in Mediation on 21.08.2019. Since the appellant is not present, this order is passed without prejudice.
