The Decree Holder however to seek the benefits of the agreement recorded by means of application under Order 23 Rule 3 CPC being IA no.11784/2000 in suit no.521/1984 in respect of any consequential action and reliefs arising on account of implementation of the terms stated in IA no.11784/2000, will be entitled to file appropriate independent proceedings. 2.

Execution petition is therefore not pressed subject to the aforesaid liberty.
