O R D E R

% 07.09.2016 By the present petition the petitioners seek quashing of FIR No. 255/2016 under Sections 452/354/323/341/506/34 IPC registered at PS Kanjhawala, Delhi on the complaint of Respondent No.2 on the ground that the parties have settled the matter.

Learned proxy counsel for the learned Additional Standing Counsel for the State submits that in the above noted FIR the two petitioners are the only accused, respondent No.2 is the complainant/victim and the respondent No.3 is the other victim.

The Respondent Nos. 2 and 3 Garima and Neeraj Kaushik who are present in Court and are identified by the Investigating Officer state that W.P.(CRL) 2233/2016

since the petitioners live in the same village and since they have apologised and assured that there will be no misbehaviour in future, respondent Nos. 2 and 3 have settled the matter with the petitioners and in terms of the settlement between the parties, they do not want to pursue the abovementioned FIR and the proceedings pursuant thereto. Petitioners, who are also present in Court and are identified by the learned counsel state that they have tendered their unconditional apology to respondent Nos. 2 and 3 for their misbehaviour and assure that no such misbehaviour or mistake would be committed in future by them and that they will abide by the terms of settlement.

In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, FIR No.

255/2016 under Sections 452/354/323/341/506/34 IPC registered at PS Kanjhawala, Delhi and proceedings pursuant thereto are hereby quashed. Parties have signed this order sheet in acknowledgment of their statements made before this Court.

The petition is disposed of. Order dasti.
