% 07.12.2018 The learned senior counsel for the petitioner, on instructions, seeks permission to withdraw the petition presented under Section 439 (2) read with Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.) vis-avis the order dated 28.05.2016 of the Additional Sessions Judge on the file of sessions case no. 54/2016 arising out of FIR No. 171/2016 of police station Lajpat Nagar, he at the same time, submitting that it may be clarified that the observations recorded by the court of sessions while granting bail to the second respondent will not be treated as conclusive. It is trite that observations in an order of such nature can never be treated as clinching, conclusive or binding.

The petition and the applications filed therewith are dismissed as withdrawn.
