% 17.10.2017 Respondent no.2 Ms. Kanika Gaba is present in Court alongwith her counsel and has been identified by ASI Darshan Kumar, PS Mianwali Nagar.
She says that she has settled the matter with the petitioner no.1 before the Mediation Centre, Tis Hazari Courts, Delhi on 22nd July, 2016. She says that her marriage with the petitioner no.1 has already been dissolved by a decree of divorce by mutual consent passed by the Family Court, Tis Hazari, Delhi on 16th March, 2017. Petitioner no.1 has paid `51,00,000/- to the respondent no.2 vide demand draft, photocopy whereof is on record. Respondent no.2 submits that with this payment, the entire settled amount stands received from the petitioner no.1 and is, therefore, she is not willing to pursue the FIR any further.
Keeping in mind that marriage between the petitioner no.1 and
respondent no.2 has already been dissolved by mutual consent and respondent no. 2 is not willing to pursue the FIR any further, in the interest of justice, FIR No. 331/2015 under Sections 498-A/406 IPC registered at police station Mianwali Nagar and the consequent proceedings emanating therefrom, are quashed.
