% 01.08.2016 By this petition the petitioner seeks quashing of FIR No. 371/2013 under Sections 498A/326-B IPC registered at PS Kotwali, Delhi on the complaint of respondent No.2.
Notice. Learned APP for the State accepts notice. On instructions from the investigating officer he states that the petitioner is the only accused and respondent No.2 only victim in the above-noted FIR and the allegations in the FIR are not of inflicting acid burns but of attempting to throw some corrosive liquid on the respondent No.2.
The complainant/Respondent No. 2 who is present in Court and is identified by the Investigating Officer states that she has settled the matter with the petitioner and is living with him as his wife for the last two years and during this period she has been blessed with a female child born on 26th CRL.M.C. 2725/2016
May, 2015. She states that since she is now happily living with the petitioner, she does not want to pursue the FIR and the proceedings pursuant thereto.
Since the parties have amicably resolved their difference and the pendency of the present proceedings will bring further acrimony and disharmony between the two, it would be in the interest of justice if the present FIR is quashed.
Accordingly, FIR No. 371/2013 under Sections 498A/326-B IPC registered at PS Kotwali, Delhi and the proceedings pursuant thereto are quashed.
Parties have signed this order sheet in acknowledgment of their statements made before this Court.
Petition is disposed of. Order dasti.
