The appellant has filed the present appeal impugning the judgment dated 31.10.2012 and order on sentence dated 02.11.2012 convicting the appellant of an offence under Section 304 Part II and Section 341 of the IPC. By the subject application it is contended that appellant has expired on 05.02.2018 and accordingly the criminal proceedings against him have abated.

The learned APP submits that the IO has verified the factum of death and confirms that the said appellant has since expired. 3.

In view of the fact that the appellant has expired on 05.02.2018, the criminal proceedings against him are abated. Accordingly, surety and surety bond are discharged. The relevant surety furnished to the Court be accordingly discharged and original documents returned to the sureties. 4.

The application and appeal are accordingly disposed of in the above terms.
