% 26.08.2016 It is pointed out that name of respondent No.2 is Sikha Gupta and not Sudha Gupta.
Sikha Gupta is present along with her son Vaibhav. Ms. Naomi Chandra, Advocate representing Delhi High Court Legal Services Committee, who is present in the Court, had interacted with Vaibhav in the chamber. Later on, we also spoke to Vaibhav in the chamber in the presence of Ms. Naomi Chandra, Advocate. Rajiv Gupta, the petitioner was also called to the chamber and had interacted with Vaibhav and had also taken
him out for lunch within the High Court complex. We have also interacted with Sikha Gupta in the chamber. Sikha Gupta has stated that she will provide a telephone number on which Rajiv Gupta can interact and speak with Vaibhav. Sikha Gupta has stated that she has no objection in case suitable arrangements are made for Vaibhav to travel to Delhi and meet Rajiv Gupta. For personal reasons, at present, Sikha Gupta is not ready and willing to give details of her residential address and school in which Vaibhav is studying.
Rs. 20,000/- deposited by the petitioner in the Court would be paid to Sikha Gupta.
The writ petition is disposed of in view of the statement made. We clarify that we have not expressed any opinion on the question of custody and guardianship of Vaibhav. It is open to the parties to raise their grievance and claim with regard to custody and guardianship in accordance with law in appropriate proceedings.
