O R D E R

% 02.09.2016 By the present petition the petitioners seek quashing of FIR No. 350/2016 under Sections 354/323/452/506/34 IPC registered at PS Jyoti Nagar, Delhi on the complaint of Respondent No.2 on the ground that the parties have settled the matter.

Learned proxy counsel for the learned Additional Standing Counsel for the State on instructions from the Investigating Officer states that the two petitioners are the accused in the above noted FIR and the respondent No.2 is the complainant and the respondent No.6 is an injured victim in the W.P.(CRL) 2205/2016

present FIR. He further states that respondent Nos. 3 to 5 have also been named in the FIR as quarrel took place with them as well. The Respondent Nos. 2 to 6 are present in Court and is identified by the learned counsel and the Investigating Officer. They state that they have settled the matter with the petitioners, who are their neighbours and in terms of the settlement between the parties, they do not want to pursue the abovementioned FIR and the proceedings pursuant thereto. Petitioners, who are also present in Court and are identified by the learned counsel state that they will abide by the terms of settlement. In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, FIR No. 350/2016 under Sections 354/323/452/506/34 IPC registered at PS Jyoti Nagar, Delhi and proceedings pursuant thereto are hereby quashed.

Parties have signed this order sheet in acknowledgment of their statements made before this Court.

The petition is disposed of. Order dasti.
