% 28.07.2016 Crl. M.A. No. 11345/2016 (Exemption) Allowed, subject to all just exceptions. Applications are disposed of. W.P.(CRL) 2170/2016 and Crl. M.A. No. 11346/2016 (stay) Present FIR No. 217/2016 under Sections 420/34 IPC was registered against the petitioners at Police Station Swaroop Nagar on the complaint of respondent no. 2.
A perusal of FIR shows that the disputes, which had arisen between the respondent no. 2 and the petitioners, were in respect of sale of an immovable property, i.e. a plot, admeasuring 25 sq. yds., forming
part of Khasra no. 17/15, Gali No. 15, Swaroop Nagar, Delhi. Respondent no. 2 and petitioners have settled their disputes amicably. Petitioners have paid `4,70,000/- to the respondent no. 2, which she has received towards full and final settlement of all her claims in respect of the land in question. Respondent no. 2 is present in Court along with her counsel and has been identified by the Investigating Officer. She admits having settled the matter with the petitioners and has also received the entire settled amount. She submits that she has no objection in case FIR is quashed. Keeping in mind that parties have settled their disputes, inasmuch as the disputes have civil flavour, in the interest of justice, FIR No. 217/2016 under Sections 420/34 IPC registered at Police Station Swaroop Nagar and the consequent proceedings emanating therefrom are quashed, subject to petitioners depositing the costs of `10,000/- each with Delhi High Court Legal Services Committee within four weeks, receipts whereof be deposited with the Investigating Officer.
Writ petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J.
