% 29.07.2016 Crl.M.A. 11392/2016 (Exemption) Application is allowed subject to just exceptions. Bail Appln. 1511/2016 Arguments heard.

The present application under Section 438 Cr.P.C. read with Section 482 Cr.P.c. has been filed by the petitioner for the grant of anticipatory bail in FIR No.98/2016, under Sections 365/323/506/34 IPC, PS Jaffarpur Kalan.

During the course of arguments, it has been disclosed that there was some dispute earlier between the accused and the complainant with regard to Rs.14,000/- to be payable by the accused and it has been alleged that a sum of Rs.51,000/- was paid by the accused to the complainant and further a sum of Rs.4 lacs is lying due against him.

Learned APP for the State has submitted that the accused/petitioner is required for investigation but not required for custodial interrogation.

In the above mentioned facts and circumstances, it is hereby ordered that in the event of arrest of the petitioner, he be released on bail on furnishing the personal bond in the sum of Rs.15,000/- with one surety in the like amount to the satisfaction of the arresting officer.

The petitioner is directed to join the investigation as and when required and shall not tamper with the evidence or influence the prosecution witnesses. He is further directed not to leave the country without prior permission of the Court concerned. The present bail application is disposed of accordingly. Dasti.
