W.P.(C) 6821/2016 Challenge in this writ petition is to the order dated 27.05.2016 passed by the Central Administrative Tribunal by which the OA filed by the petitioner stands dismissed.

Learned counsel for the petitioner submits that the Tribunal has failed to take into consideration that in fact there is no misconduct and thus, the inquiry and all proceedings arising therefrom are liable to quashed. Mr. Singh, learned counsel for the respondent enters appearance on an advance copy and submits that the Tribunal has correctly applied the law and dismissed the OA. At this stage, Mr. Sharma submits that without prejudice to the rights and contentions of the parties, the petitioner would be satisfied that if

a direction is issued to the respondent to complete the inquiry expeditiously. Mr.Singh, counsel for the respondent submits that the respondent would have no objection to the same, subject to the condition that the petitioner cooperates in the inquiry.

Based on the submissions made by the counsel for the parties, the petition is disposed of with a direction to the respondent to complete the inquiry proceedings within six months from today. The petitioner is directed to cooperate with the respondent in the inquiry proceedings. The writ petition and all applications stand disposed of. G.S.SISTANI, J I.S.
